Emerald Square Parking
The Board has been made aware of a recent dispute between residents on parking in a communal area of the square. The Board thought it would be useful to set out the Board’s current policy.
Residents will be aware that a strict reading of the covenants, which bind us all, means that no parking is allowed on any communal part of the square.
The Board has recognised that residents have not wished to be subject to such strict enforcement . This is so all residents benefit from a more relaxed scheme where occasional parking, where such parking doesn’t obstruct the free flow of traffic, is allowed.
This means that routine use of a communal area by either a resident or visitor is not permitted.
The key is what we mean by “routine”. We see that a common sense approach would mean that “routine” would cover parking over more than one or perhaps two days, whether by a resident or not and whether or not in the exact same place or not. If a property has one parking space but the owners have two cars, then one of their cars would have to be parked away from the square. Equally, if a property has a regular and frequent visitor parking for more than a short period of time, say a few hours, then that visitor should park in Roehampton Lane rather than on a communal area.
If there is abuse of this policy then it should be reported in the first place to the managing agent, Urang as from March. If an abuse of the policy continues, then Urang will issue an enforcement notice together with an administration charge of £100.
